Car Rentals: Terms and Conditions

Following are the some general terms and conditions regarding car booking from ChalUttaranchal (Bangaree Infotech Solutions). The link of these terms is always mentioned in the chain of mails, when you book car rental from us. We consider that you have read all the terms and conditions and agree before booking the any vehicle as car/cab/taxi from us.

    • AC will not work in hill areas or stopped / parked vehicle.
    • Driver will not drive on No-entry zones and should not be forced to drive on narrow streets or roads which can create traffic jam.
    • In some hill area roads driving after sunset and music is not allowed due to risk of life. Kindly cooperate for the same.
    • In case of snowfall / road block on the road car will not go ahead. Additional / further transfer must be arranged at your own cost.
    • Pick up and drop point will be one only (If multiple pickups and drop please mentions email conversation before booking)
    • Parking will be paid one place one time at each day. In same day if guest want to visit the place again it should be paid by guest.
    • Total amount is valid only for places which is mention in tour itinerary.
    • Tour destination / route cannot change without prior notice (Amended route and tour Destination rates may be change)
    • We count 1 day from 6 am till 9 pm if you need vehicle before 6 am or after 09 pm in that case client will pay extra charges.
    • If the vehicle is not in the good condition, please contact company immediately.
    • The rates are subject to change, depending on the fluctuation of diesel/Petrol prices in India. If the prices increased more than 5% than the time of booking we will increase the rate even if the rates are confirmed earlier.
    • Any abuse to our drivers or unacceptable behavior or driver feels in risk the driver has the right to ask the passengers to leave the vehicle.
    • Bangaree Infotech Solutions (ChalUttaranchal) reserves the right to give you a similar car if the car you booked is unavailable.
    • To reach airport/railway transfers/some important meeting on time it is the customer’s responsibility to inform driver or company at enough notice to reach at place on time. Any delay due to unavoidable circumstances like road block, strike, traffic jam, technical breakdowns, accidents, severe weather conditions, natural disasters or any other situation beyond our control Bangaree Infotech Solutions (ChalUttaranchal) is not held responsible.
    • Please inform & Discuss with your driver about your tour schedule and Itinerary.
    • Don’t force driver to drive beyond the safe speed limit.
    • At many of the tourist destination / hill station – some of the road / shopping market / mall road have “NO ENTRY” for all / some bigger tourist vehicles depends on destination along with time restrictions also. In this kind of situation guest have to manage another available mode of transport with an additional cost and on direct payment basis, this cost is not included in ideal package inclusion.
    • Some time vehicle parking area little far from the sightseeing spots. Guests need to reach the parking at their own cost.
    • Vehicle will be permitted to use for sightseeing points on the route and inside the city limits or which is mentioned in itinerary. For additional sightseeing, off route sightseeing, sightseeing not inside the city limits or substitute sightseeing kindly contact company. Refund is not possible if any particular sightseeing point is not covered. In case you want some excursions kindly inform company in advance or discuss these things with company rather than driver.
    • All nearby sightseeing points should be covered together. Vehicle will not come again on the same route for a sightseeing which has been left. However in case of sometime issues with some particular place we can adjust.
    • Any cost increased due to circumstances beyond our control resulting in forcefully extra days will be charged at nominal charges.

Payment Terms:

    • Advance payment must be paid for each booking as per the email conversation.
    • Driver will take full balance payment at pick up time at hotel / airport / railway station / Home. If the payment on the credit card / Debit Card / Net Banking is declined / Failed for some reason, for alternate payment instructions you must call in Bangaree Infotech Solutions (ChalUttaranchal), 72 hours prior to the time of departure, else the order is liable to be cancelled.
    • Sometimes Online Payment takes 24 hours to 36 hours To Reflect Amount in Our Account and We Cannot Confirm or Provide any Services unless we received amount.

Breakdown Policy:

    • Our booked vehicles are well maintained and are regularly checked up at service centres. Due to any reason (beyond our control) if the vehicle breakdown anywhere Bangaree infotech Solutions (ChalUttaranchal) is not responsible. We will try our best to arrange another vehicle as soon as possible for the major problems. For minor problems which will not take much time vehicle will be repaired. Kindly cooperate. In case of flight delays or hotel cancellation we are not responsible if it is not our fault.
    • We shall not be responsible for any delays & alterations in the program or expenses incurred directly or indirectly due to natural hazards, flight cancellations, accident, breakdown of transport, weather, sickness, landslides, closures/blocks due to political unrest or any such incidents.

Cancellation and Refund Policy:

    • 10% cancellation charges (which includes transaction fees) will be deducted, rest will be refunded, if canceled 48 hrs before the pickup time. Refund will be provided only if the cancellation is confirmed by us over Email only.
    • One day vehicle charges will be charged against the cancellation in last 48 hrs. Company reserves the rights to provide refund on case to case basis.
    • Refund of amount can takes upto 10-15 days from the date of approved cancellation.

Your refund request will be answered and processed promptly. If you do not receive a reply within one business day, please call the at our support number below. We will not be responsible if email, mail fails to reach us.

All the refund/cancellation requests shall be sent through email/mail in writing and be sent at the earliest possible. No refund shall be processed unless a written request (email or mail) is received.

Mode of Refund and Timeframe: Refunds will be processed to your bank account only and may take upto 10-15 business days. All the refunds will be done through NEFT transfer only. No refund will be done through cash.

Travel Bookings: Terms and Conditions

Following are the some general terms and conditions regarding Fixed Departure, Customized, Char Dham, Hotel Booking or Helicopter tour/travel package booking from ChalUttaranchal (Bangaree Infotech Solutions). The link of these terms is always mentioned in the emails. We consider that you have read all the terms and conditions and agree before booking the any tour, trekking, activity package from us.

General Tour/Travel Package Terms and Conditions

    • All the Rates mentioned are valid for Indian Nationals Only.
    • Tariff for Foreign Nationals/NRIs are on request.
    • Please read emails carefully and understand the contents and prices. All the email conversations will be also part of your contract with us once you make the booking.
    • General hotel Check In Time: 1 pm and Check Out Time: 11 am (for accommodations)
    • If arrival time is not mentioned, the reservations will be released at 6 pm.
    • The Applicable Tariff, packages are subject to change without prior intimation.
    • In case of non-availability of the rooms at our respective hotels for reasons, The Hotel would be arranging alternative/ similar accommodation.
    • Activities mentioned are subject to the group size, climatic conditions, accessibility due to rain or snow. Instructor/Guide decision will be final. As we have not charged extra for activities, there are no refunds if any activities are not conducted.
    • Hotels suggested above is subject to availability on dates and prior confirmation and in case we do not find rooms in above hotels in any circumstances we will arrange the same in similar category hotels for parallel arrangements.
    • Charges for AC / Heater will be extra and as per hotel to hotel basis.
    • Please take care of the belongings before leaving the car or Hotels. Company is not responsible for any loss.
    • As per the directive given by the Government of India, all Indian/Foreign Nationals are required to provide proper proof of identification upon check-in. Valid identifications documents are: Passport & Visa together, Voters Id card, Current Drivers License. All the documents must include a photograph.
    • Hotel / camps or any kind of accommodation can deny stay if valid id proof is not provided. Company is not responsible for any ID proof related issues.
    • For extra adult many hotels provide extra mattress also instead of extra bed. Kindly inform us in advance if you prefer only extra bed instead of extra mattress.
    • In case of fixed departure tours with transportation, Sitting arrangements in BUS /Tempo will be on rotation basis. Our representative will guide you for this your along with your cooperation.
    • Due to any reason if Vehicle breakdown due to technical reasons we will try our best to arrange another vehicle as soon as possible for the major problems. For minor problems which will not take much time vehicle will be repaired. Kindly cooperate.
    • We shall not be responsible for any delays & alterations in the program or expenses incurred directly or indirectly due to natural hazards, flight cancellations, accident, breakdown of transport, weather, sickness, landslides, closures/blockades due to political unrest or any such incidents.
    • AC will not work in all hill areas or stopped / parked vehicle.
    • In case of packages with Transportation, Vehicles are on Disposal from pre advised meeting point. Client may arrange on their own to get transfer to the pickup/drop point. Vehicle Charges are inclusive of all toll taxes / parking and driver allowance.
    • Driver will not drive on No-entry zones and should not be forced to drive on narrow streets or roads which can create traffic jam. Normal working hours of driver is 12 hrs in case you want services more than 12 hours in a day kindly inform us in advance.
    • In some hill area roads driving after sunset and music is not allowed due to risk of life. Kindly cooperate for the same.
    • Pick up and drop point will be one only (If multiple pickups and drop please mentions email conversation before booking)
    • The rates are subject to change, depending on the fluctuation of diesel/Petrol prices in India. If the prices increased more than 5 % than the time of booking we will increase the rate even if the rates are confirmed earlier.
    • We reserves the right to give you a similar car if the car you booked is unavailable.
    • At many of the tourist destination / hill station – some of the road / shopping market / mall road have “NO ENTRY” for all / some bigger tourist vehicles depends on destination along with time restrictions also. In this kind of situation guest have to manage another available mode of transport with an additional cost and on direct payment basis, this cost is not included in ideal package inclusion.
    • It is presumed that the tourist is medically fit to undertake the tour. If you have certain kind of allergy (especially for food) or any serious health issues kindly inform us in advance.
    • No refund for short stay or unveiled facilities.
    • GST Taxes extra as per Government notification.
    • Confirmation is subject to force majeure clause
    • No cancellation or any refund will be made if situation is beyond our control, such as bad weather, landslide, climatic conditions or any other natural disaster, fire, any embargo, acts or decisions of government, political or national crisis, road blocks, heavy snow fall, acts of terrorism or other similar causes, strikes or problems at airlines, rails, buses, hotels or transporters, labor unrest, insolvency, business exigencies, operational and technical issues, route and flight cancellations or due to which the customer could not reach the destination and which is beyond our control.
    • Company is not responsible for any accident/injury/death/theft of person or property during the course of the tour.
    • All rights reserved to management to cancel any service without any refund until full advance money towards the service is received from the customer and accepted by company. Company can change the features or functionality of the services at any time, without any notice.
    • We as a service provider shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
    • Bangaree Infotech Solutions (ChalUttaranchal) Here by expressly disclaims any implied warranties imputed by the laws of any jurisdictions or country other than India. Bangaree Infotech Solutions Services considers itself and intends to the jurisdictions only of the court of Dehradun India.

Trekking Package Terms and Conditions

    • Any expenses due to unforeseen circumstances shall be shared.
    • All trekkers are expected to carry their own backpacks with personal belongings.
    • Himalayas are unpredictable. In some cases due to bad weather it is possible that the trek cannot be completed. ChalUttaranchal will do their best to make it possible but your safety is a much bigger concern for us.
    • ChalUttaranchal reserves the right to modify or cancel the trek or trek itinerary under unusual and unforeseen circumstances.
    • The treks we offer demands a person to be physically fit & mentally strong. Before booking the trek please tell us if you have any medical condition.
    • No refunds will be made for any accommodation, sightseeing, meals or services not utilized.
    • You are solely responsible for your personal belongings during the trek.

    • Baggage and personal items are at your risk throughout the trip. You are solely responsible for your personal belongings during the trip. Kindly do not carry any valuables during the trek, we are not responsible for any loss of baggage, goods, air tickets, passport, cash, traveller’s cheques, or any other travel document or item owned by you while on tour, whatever the cause.
    • Trekking in Himalayas requires a degree of personal risk. You are likely to visit places where you’ll be facing certain risks, dangers and physical challenges. By participating in a trek with ChalUttaranchal, you accept that you are aware of the personal risks & dangers attendant upon such travel and that you assume the risks involved. You hereby assume all such risks and release ChalUttaranchal from all claims and causes of action arising from such damages or injuries or death resulting from these inherent risks.
    • In the case of falling ill or suffering an accident during the trip, all hospital expenses, doctor fees, evacuation from road or mountain or any other charges incurred as a direct or indirect result of your illness/accident are your responsibility.
    • We reserve the right to photograph you during the trek and use the image for our website & promotions.

Helicopter Package/Ticket Booking Terms and Conditions

    • Maximum 04 Passengers will be allowed in 01 Helicopter.
    • Total passenger weight will not be in the excess of 300 Kgs .
    • Maximum Baggage Allowance 5Kgs/Person.
    • Passenger may carry only one small pack of not more than 2 Kgs of weight in Flight.
    • Excess volume baggage would not be allowed on Helicopter flight.
    • Price is subject to change without prior notice. Please confirm in advance.
    • All reporting timings from point to point flying will be confirmed to client from our end. Charters and crew members can be changed as per availability. Timing of transfers from each flying point to another can be changed last moment as per availability or weather conditions.
    • Exact schedule can be advised before a day of departure. Mentioned schedule in mail/invoice is tentative just for understanding the operational system & timing. Things can be changed last moment due to any operational or weather changes.
    • We can cancel the provided or confirmed charter services any moment before flying due to any operation retrains and technical problems.
    • We cant take guarantee of your flying on date or on time later or sooner. Its total matter of third party services depending on their operational restrains and previous loads.
    • We can only assure you 100% refund in case of any cancellation under any unforeseen reason.
    • We are also not responsible for any kind of claim or complains raised against any problem in flying. We can only assist you for better and convenient flying without giving assurances for third party (aviation) services.
    • During Char Dham helicopter package, We can also stay in Kharsali Or Harsil as first night stay due to weather or operational clearance. So this should be well understood to passengers before they accept the proposals to avoid any last moment confusion.
    • In case of extra night stay due to weather or any technical problem the stay and food expenses will be bear by passengers only. We will bear the cost of crew and craft on our own.
      We will only wait for 01 additional night to cooperate with the situation in terms of completion of the Yatra. Any extension is not allowed in above cost and conditions. We can cancel the yatra in any such situation of waiting due to weather or any problem.
    • A final deposit of 100% of tour cost is required to secure your reservation. Deposit of payment as per your selected tour is required prior to commencement of tour or as per agreed at the time of confirmation of the tour.
    • Prices do not include charges for laundry service, telephone and Internet usage, wines, liquors, mineral waters, travel insurance, international flight tickets, India visa fees, tips, monument tickets, movie/video camera fee at monuments, miscellaneous expenses, souvenirs or any other expenses which is not specified.
    • Other fees may be imposed by airlines which are the passenger’s responsibility.
    • Making Changes: Most programs allow travel deviations that affect destination, departure date, program extensions, and the like. Note that tour plan can be changed; provided that requests are made in writing 21 days prior to the commencement of tour. No deviations can be made or processed within 21 days of commencement of tour.

Cancellations and Refund Policy:

    • Within 15 days of Arrival Date/ No Show: No Refund
    • 15 Days to 30 Days prior to Arrival: 50% of the total package cost.
    • 30 Days & More: 10% of package cost (and taxes are not refunded in any case)
    • Note: No refunds in case of Road Blocks, Accidents, etc

Mode of Refund and Timeframe: Refunds will be processed to your bank account only and may take upto 10-15 business days. All the refunds will be done through NEFT transfer only. No refund will be done through cash.

Hotel Booking Process

There is always a gap from the point we confirm you the availability, you confirm it back and we confirm the same to the hotel/resort and availability status may change during this period. e-mail confirmations are typically done and e-mailed the same working day.

Procedure for Making Payments

A. Payment by Cash/Cheque
We will e-mail or fax a Before Payment booking note for you to deposit payment by cheque or cash in HDFC Bank. Thereafter User has toe-mail or call or fax deposit slip and intimate that such a deposit is done. We will then send (e-mail, post, courier, fax) an after payment booking note

B. Online Transfers
You can also transfer the booking amount through Internet banking, by adding our account details. As adding our details and online transfer may take upto 2-3 working days, which is more than the grace period to receive the payment. In such cases if rooms are not available and we receive the payment, the alternative accommodations will be arranged by us and it is subject to availability only. Otherwise the complete amount will be refunded.

The booking is not confirmed till we send you booking confirmation mail with receipt. In case we receive the payment and there are no rooms available then the full booking amount is refunded.

Policy in case of a Cheque Bounce or Signature Mismatch – In case of bounced cheque you will be required to send another payment or the booking will lapse. If the cheque bounces after date of departure then you will be liable for the payment.

What is before payment and after payment booking notes?
Confirmation note sent to enable you to process payments is a before payment note. Here hotel numbers are not mentioned. Confirmation receipt sent after you process payments is a after payment note. Here hotel numbers are mentioned.

Policy on refusal of the hotel to accommodate guests : Guests are expected to adhere to local laws and Hotel rules during the stay and Bangaree Infotech Solutions (ChalUttaranchal) shall not be responsible for any refunds if the guests is unable to comply to local law / Hotel rules and enforcement procedures / requirements. In case hotel does offer a cancellation and refund for such a case, Bangaree Infotech Solutions (ChalUttaranchal) would be pleased to forward to the guests in full. Please review list of conditions when guests can be denied entry or even forcibly evicted.

 

Hotel Resort Booking

    • The inclusion of ‘extra bed’ with a booking is facilitated with a folding cot or a mattress as an extra bed.
    • According to government regulations, a valid Photo ID has to be carried by every person above the age of 18 staying at the hotel. The identification proofs accepted are Drivers License, Voters Card, Passport, Ration Card. Without valid ID the guest will not be allowed to check in. Note- PAN Cards will not be accepted as a valid ID card.
    • Early check-in or late check-out is subject to availability and may be chargeable by the hotel. The standard check-in time is 12 PM and the standard check-out time is 10 AM. After booking you will be sent an email confirmation with hotel phone number. You can contact the hotel directly for early check-in or late check-out.
    • The room tariff includes all taxes. The amount paid for the room does not include charges for optional services and facilities (such as room service, mini bar, snacks or telephone calls). These will be charged at the time of check-out.
    • The hotel reserves the right of admission. Accommodation can be denied to guests posing as a ‘couple’ if suitable proof of identification is not presented at check-in. ChalUttaranchal will not be responsible for any check-in denied by the hotel due to the aforesaid reason.

Booking Confirmation

By agreeing to make payments and/or accept confirmation note/voucher, guests implicitly agree to following Terms & conditions and are aware of the clarifications and details provided as under:

Position of Bangaree Infotech Solutions (ChalUttaranchal) Vis a Vis Hotels / Service Providers

    • Bangaree Infotech Solutions (ChalUttaranchal) is a Travel Research organization and it earns commissions from respective resorts for making reservations.
    • Bangaree Infotech Solutions (ChalUttaranchal) under no conditions should be assumed to be “Authorised Agent” / “Official” / “Special Agent” / “GSA” for the Hotel/Resort/Service Provider.
    • Bangaree Infotech Solutions (ChalUttaranchal) is an independent entity that facilitates reservations and should be under no circumstances to be assumed as the “local representative”.

Position of Bangaree Infotech Solutions (ChalUttaranchal) Vis a Vis Deficiency of Service

Bangaree Infotech Solutions (ChalUttaranchal) personnel have verified information listed on the www.chaluttaranchal.com. All options will not be suitable for all segments of guests and therefore guests are expected to take their own decisions and form their own judgments based on information available. When in doubt, before making a reservation the guests are expected to raise queries and clarify issues if any.

Bangaree Infotech Solutions (ChalUttaranchal) is a travel planning service and strives to give suggestions as per best available information. However in case any shortfall in services (as against what is promised or what can be reasonably expected for such a service) by any hotel or service provider is established, Bangaree Infotech Solutions (ChalUttaranchal) would stand responsible for making appropriate refunds. But the refund amount will be sole discretion of Hotel or Service provider.

Position of Bangaree Infotech Solutions (ChalUttaranchal) Vis a Vis Cancellations and postponements

For any reason if the hotel or service provider or Bangaree Infotech Solutions (ChalUttaranchal) has cancelled the reservations (Overbooking, wrong booking or any other reason), then immediate refund shall be given to the guest without any deduction.

    • For any cancellation made by the guest, service tax amount will not be refunded.
    • For any cancellation made by the guest, Bangaree Infotech Solutions (ChalUttaranchal) mirrors Cancellation and Postponement policy of the Hotel / Service Provider. Guests are expected to verify hotel cancellation and postponement policies.
    • No refund for last minute cancellation or cancelling the rooms after reaching resort.

Following possibilities exist here:
1. City hotels may levy 1 or more night cancellation charge if cancelled before a specified period of time as per their cancellation policy.
2. Leisure segment hotels / resorts may levy charges if cancelled within a time limit before the reservation as per their cancellation policy.
3. Remote location hotels may not offer any refunds or may offer postponements with some terms and conditions attached.
4. Hotels / Service Providers in Peak Season (e.g. Christmas and New Year Holidays, Summer Holidays, or any other long weekend holidays, etc) may not offer any refunds and charge for postponements or re-adjustment of dates.
5. Hotels / Service Providers have stricter last minute cancellation policies. Hotels / Service Providers are not responsible for connecting events related to the access (in event of your flight being cancelled, hotel may not offer any refunds).

Bangaree Infotech Solutions (ChalUttaranchal) may levy a minor service charge for processing cancellations made by the guest. Following are possibilities:
1. Some Hotels / Service Providers may take some time for refunds and some hotels / Service Providers may expect Bangaree Infotech Solutions (ChalUttaranchal) or guest to adjust the amount in future reservations. Guests have to wait till this happens. Bangaree Infotech Solutions (ChalUttaranchal) will update the guest on a regular basis on the status of the adjustment / refunds.
2. For peak dates Some Hotels / Service Providers may not allow for any refunds or adjustment and would expect guest to travel anytime in a specified period of time. Bangaree Infotech Solutions (ChalUttaranchal) will issue a credit note to the guest, which can be availed in the specified time direct with the hotels / Service Providers.
3. For peak dates Some Hotels / Service Providers may not give any refunds. Bangaree Infotech Solutions (ChalUttaranchal) will be able to refund the commission amount it earned from the reservation.
4. Payment is never held by Bangaree Infotech Solutions (ChalUttaranchal) on behalf of the hotel and is always dispatched to the hotel / Service Provider within 48 hours of the receipt to ensure that the room is held on a firm basis.
5. Under any circumstances Bangaree Infotech Solutions (ChalUttaranchal) is bound by the Hotel / Service Providers rules and will process cancellations and will act as per that. Bangaree Infotech Solutions (ChalUttaranchal) is obliged to do co-ordination on behalf of the guest. However in case of any legal dispute related to refunds, cancellations, postponements etc., guest will have to take that up directly with the hotel / Service Provider management. Bangaree Infotech Solutions (ChalUttaranchal) will be obliged to provide all contact details, documentation and other support to facilitate such an action, as the guest or guest’s legal counsel may require it. However on-site representation of the case will not be possible.
6. All refunds will be made by the same mode as the payment was made. In event of a credit card not in use, guests may be asked to provide alternative means of refunds. Any cost related to the alternative means, will have to be bourne by the guest and refund will be paid after deducting the charge.

Foreign Currency Transactions / Overseas Payments

    • Any Hotel / Services confirmation note stating rupee amount and accepted via rupee payment channels such as payment gateway and bank transfers, guest will be given credit for actual rupee credited in the account and no further charges are leviable.
    • Any Hotel / Services confirmation note stating rupee amount and any estimation provided to guest in terms of possible equivalent foreign currency payable, the amount so stated will remain as an estimation and actual amount will depend on the rate of exchange (ROE) at the time of the transaction.
    • Payment shall be recognised only when it arrives either with Payment Gateway or with the Bank and no payments in transit or ones made and not received at the Bangaree Infotech Solutions (ChalUttaranchal) end shall be considered responsibility of Bangaree Infotech Solutions (ChalUttaranchal). Due diligence need to be made by guests while transferring payments in making sure that correct details and methods are used as recommended by the Bangaree Infotech Solutions (ChalUttaranchal) personnel.

General Cancellation Terms*:

    • Less than 7 days before booking date: No Refund
    • 7 to 14 days before booking date: 50% of booking amount
    • More than 15 days: 75% of booking amount
    • Refund process may take upto 30 days. Terms and Conditions applicable

* The refund policies vary from hotel to hotel. The refund policy of the hotel will be applicable for any refund amount. There will be no refund during Christmas, New Year Holidays, long holiday weekends, remote resorts and destinations.

If a booking is cancelled or changed by the customer, the hotel will be notified (of the changes) and the original confirmation email and Booking ID that was generated will become null and void.
